The Cormac McEnery Law Firm provided professional, kind and compassionate care for our family in drafting the Last Will and Testament for our mother, and then after her passing, handling the myriad of details and contacts with the courts and all her legal and financial affairs. Mr. McEnery and his paralegals Betty and Peggy cared for every detail with very quick and accurate responses. You are made to feel welcome as soon as you walk through the door of their City Island, New York offices. We were glad to have found them to help us!

FAQ

Do I need an estate plan if I already own property in Westchester County?

Yes. Owning property makes estate planning essential. Without a plan, New York’s intestacy laws decide who inherits, which may not reflect your wishes.

Can I challenge a will in Westchester County if I believe it was signed under pressure?

Yes. New York law allows you to contest a will for undue influence, lack of capacity, or improper execution.

How long a probate proceeding take in Westchester Surrogate’s Court?

On average, probate in Westchester can take 9–18 months, depending on complexity and whether disputes arise.

How does co-op or condo law differ in the Bronx compared to Westchester?

City properties often involve stricter co-op board approval and unique bylaws. Having counsel familiar with both borough and county rules is crucial.

What can I do if siblings disagree about selling inherited property left by parents?

If no agreement is reached, one heir can bring a partition action in court. Mediation or negotiated settlements are often faster and less costly.

What’s the difference between a will and a trust when planning your estate?

While a will typically goes through probate—though it is not always required depending on the estate—a trust can transfer assets directly to beneficiaries, saving time and court costs. Many families use both.
